Please read these Terms of Use ("Terms") carefully before using the Olive Food Scanner iOS application and the associated website (the "Service") operated by Olive Food Scanner ("we," "us," or "our"). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service. Use of the Service is also subject to our Privacy Policy, which is incorporated herein by reference.
By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. In jurisdictions where minors may use the Service only with parental consent, such consent is required.
You represent and warrant that you are at least the age of majority in your jurisdiction (or have parental or guardian consent where required) and that you have the legal capacity and authority to enter into these Terms. You further represent that you will use the Service only in compliance with these Terms and all applicable laws.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use only, in accordance with these Terms and applicable law. No other right, title, or interest in or to the Service or any Content is transferred to you.
You agree not to, and shall not permit others to: (a) copy, modify, distribute, sell, or lease any part of the Service or Content; (b) reverse engineer, decompile, or attempt to extract the source code of the Service or any component thereof, except to the extent such restriction is prohibited by applicable law; (c) use the Service for any illegal or unauthorized purpose or in violation of any applicable law; (d) use automated means (e.g., bots, scrapers) to access the Service or collect Content without our prior written consent; (e) overload, disrupt, or impair the integrity or performance of the Service or our systems; (f) remove, alter, or obscure any copyright, trademark, or other proprietary notices; or (g) use the Service to harm, harass, or infringe the rights of any person or entity. We reserve the right to suspend or terminate your access to the Service for any violation of these Terms.
All right, title, and interest in and to the Service, the Content (other than content you provide), and all related branding, trademarks, and materials are and will remain the property of Olive Food Scanner or its licensors. Nothing in these Terms grants you any right, license, or interest in such materials except the limited license expressly set forth in Section 4. You may not use our name, logo, or trademarks without our prior written consent.
To the maximum extent permitted by applicable law, the Service is provided for educational and informational purposes only.
The Service is not a medical device, and nothing in the Service constitutes medical advice, diagnosis, treatment, or a substitute for professional healthcare. Always consult a qualified healthcare provider regarding any dietary or medical concerns. We do not guarantee the accuracy, completeness, or reliability of any ingredient analysis, product scoring, or other Content, as product formulations may change without notice and automated or AI-based analysis may contain inaccuracies.
THE SERVICE AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND COURSE OF PERFORMANCE. WE DO NOT WARRANT THAT (A) THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (B) ANY ERRORS OR DEFECTS WILL BE CORRECTED; (C) THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (D) THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL OLIVE FOOD SCANNER, NOR ITS DEVELOPERS, DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, HEALTH, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH (I) YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY; (III) ANY CONTENT OBTAINED FROM THE SERVICE, INCLUDING MISTAKEN OR INACCURATE INGREDIENT ANALYSIS; OR (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR DATA, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY.
IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US (IF ANY) IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100 USD). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
You agree to indemnify, defend, and hold harmless Olive Food Scanner and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property or privacy right; or (d) any claim that your use of the Service caused damage to a third party. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, at your expense.
Certain aspects of the Service may be offered on a subscription basis ("Pro Features"). Payment will be billed in advance on a recurring basis (e.g., monthly or annually) through your Apple ID account. Price changes, if any, will be communicated in accordance with applicable platform rules. Failure to pay may result in loss of access to Pro Features.
As described in our Privacy Policy, we do not store your personal information on our servers. You agree not to use the Service in any way that violates any applicable national, state, local, or international law or regulation, or that infringes the intellectual property, privacy, or other rights of any third party. You are solely responsible for your conduct and for ensuring that your use of the Service complies with these Terms.
We may suspend or terminate your access to the Service at any time, with or without cause or notice. You may stop using the Service at any time. Upon termination, your right to use the Service ceases immediately. The following sections shall survive termination: Sections 6 (Intellectual Property), 8 (Disclaimer of Warranties), 9 (Limitation of Liability), 10 (Indemnification), 14 (Governing Law and Venue), and 15 through 18 (Severability, Waiver, Assignment, Entire Agreement).
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any dispute arising out of or related to these Terms or the Service shall be brought exclusively in the state or federal courts located in the State of California, and you consent to the personal jurisdiction of such courts.
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties' intent, or, if modification is not possible, severed. The remaining provisions shall remain in full force and effect.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by us to be effective.
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign our rights and obligations under these Terms without your consent, including in connection with a merger, acquisition, or sale of assets.
These Terms, together with the Privacy Policy and any other policies or guidelines referenced herein, constitute the entire agreement between you and Olive Food Scanner regarding the Service and supersede any prior agreements, communications, or understandings, whether written or oral.
We reserve the right to modify these Terms at any time. We will post the updated Terms on the Website and, where appropriate, in the App or App Store listing, and will update the "Last Updated" date. Material changes may be communicated with reasonable notice where feasible (e.g., thirty (30) days before taking effect). Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
